Terms of Service
Last updated: October 31, 2026
1. Scope and contracting party
(1) These Terms of Service apply to every consultation and engagement you agree with us. Your contracting party is MTB Advisors Austin LLC, a Texas limited liability company, 8000 Centre Park Drive, Suite 130, Austin, TX 78754, USA ("we", "us").
(2) A contract is governed by the version of these Terms published on this website when the contract is formed. Different terms apply only if we agree to them in writing.
2. Our services
(1) We provide advisory services: US market entry advisory, relocation support, banking advisory and US operations support, as described on this website. What we do in an engagement is set out in the written scope you accept.
(2) We are an advisory firm. We do not provide legal or tax advice, we do not hold client money and we do not give investment advice. Where a matter requires legal or tax work, including visa matters, it is carried out by independent US attorneys or CPAs who are engaged for that matter and work under their own engagement terms. We coordinate their work with ours.
(3) Decisions by authorities, banks and other third parties, such as a government agency, a consulate or a bank, are made by those bodies alone. We owe you careful advice and preparation, not a particular decision, account opening or visa.
(4) Timelines we give are estimates based on experience. They run from the time we have received everything we need from you. Waiting times at agencies and banks are beyond our control.
3. How a contract is formed
(1) You can request a consultation through the form on this website, by phone or by email. The contract for the consultation is formed when we confirm the appointment in writing.
(2) An engagement is formed when you accept the written scope we send you, by signature or by written confirmation.
(3) The contract language is English.
(4) Before we start, we confirm the identity of our client and of the people who own or control a client company. We may decline a consultation or an engagement, for example if these checks cannot be completed or if we cannot take on the matter. If you have already paid, we refund the full amount in that case.
4. Fees and payment
(1) All prices are in US dollars. Our hourly rates and the fee for the initial consultation are published on our Fees page. The rates in force when you accept a written scope apply to that engagement.
(2) We record time electronically and bill to the quarter hour. The written scope states the estimate and when invoices are issued. On request, we attach the timesheets to every invoice.
(3) The initial consultation ($850, up to 60 minutes) is paid in advance.
(4) You can pay by card or by bank transfer in US dollars. Card payments are processed by Stripe; we do not receive or store your card details.
(5) Government fees and third-party costs are passed on at cost. Fees of independent attorneys and CPAs are quoted to you before they start work.
(6) Nothing renews automatically and we never charge a card without your instruction.
5. Consultations
(1) A consultation lasts up to 60 minutes and takes place by phone or video call.
(2) If you are not satisfied within the first 15 minutes, you can end the consultation and receive the full fee back. After the first 15 minutes, the fee is binding.
(3) Cancelling and rescheduling a booked consultation are covered by our Refund and Cancellation Policy.
6. Your cooperation
(1) You give us complete and truthful information and provide documents and decisions on time. If anything material changes, you tell us.
(2) We are not responsible for delays or disadvantages caused by missing, late or incorrect information.
(3) You use our services only for lawful purposes. If we have reasonable grounds to suspect money laundering, a sanctions violation or another unlawful purpose, we may stop work and terminate the contract for cause. Work already performed remains payable.
7. Refunds and cancellation
When we refund fees, how you can cancel a consultation and how you can end an engagement is set out in our Refund and Cancellation Policy, which forms part of these Terms.
8. Termination
(1) You can end an engagement at any time by notice in writing. You pay for the time recorded up to the date we receive your notice.
(2) We can end an engagement by notice in writing. If we do, we hand over your documents and refund any amount paid in advance for work not yet performed.
(3) Each party's right to terminate for cause is unaffected.
9. Notices
(1) Send notices to us, such as a termination or a refund request, by email to info@mtbadvisorsaustin.com or by mail to MTB Advisors Austin LLC, 8000 Centre Park Drive, Suite 130, Austin, TX 78754, USA.
(2) We send notices to the email or mailing address you last gave us.
10. Confidentiality and personal data
(1) We treat everything we learn about you and your company as confidential. We share it only where the engagement requires it, for example with a bank or with the independent attorneys and CPAs working on your matter, where you consent, or where the law requires it.
(2) How we process personal data is explained in our Privacy Policy.
11. Our work product and website content
You may use the documents we prepare for you for your own purposes and those of your company. Texts, graphics and photographs on this website are protected by copyright; any use beyond reading and printing for your own reference requires our written consent.
12. Liability
(1) Our liability is limited to the fees you paid for the engagement concerned. We are not liable for lost profits, indirect damages or consequential damages.
(2) This limitation does not apply in cases of intent or gross negligence.
(3) We are not liable for decisions of authorities, banks and other third parties under section 2(3), or for the work of independent attorneys and CPAs, who are responsible for their own work.
13. Force majeure
If we cannot deliver a service on time because of an event beyond our control, such as a government system outage or a natural disaster, our deadlines are extended by the duration of the disruption. If it lasts longer than 60 days, either party may end the affected contract, and we refund amounts paid for work not yet performed.
14. Governing law and disputes
(1) All contracts with us are governed by the laws of the State of Texas and the federal law of the United States.
(2) Disputes arising from or in connection with a contract with us are finally resolved by arbitration under the rules of the American Arbitration Association, seated in Travis County, Texas. Each party may bring claims only individually, not in a class or collective action. Claims within the jurisdiction of a small claims court may still be brought there.
15. Changes and final provisions
(1) A contract is governed by the version of these Terms in force when it was formed. We announce changes on this page with a new date.
(2) If any provision of these Terms is invalid, the remaining provisions remain in effect.
